Welcome to Content Caster. These Terms of Service set out the terms on which you may use our website and the terms that apply when you purchase our webinar production and hosting services.

By accessing this website or engaging Content Caster to provide services, you agree to these Terms of Service.

Part A: Website Terms of Use

1. Who We Are

Content Caster provides webinar creation, management and hosting services. Until formal incorporation, Content Caster refers to the business owner trading under this name.

2. Use of Our Website

You may use this website for lawful purposes only. You must not use the site in a way that:
• breaches any applicable local, national or international law or regulation
• is unlawful or fraudulent
• is harmful to others, including transmitting viruses or harmful code

We may update or withdraw parts of the site at any time without notice.

3. Intellectual Property

All content on this website, including branding, logos, copy, graphics, images and videos, is owned by or licensed to Content Caster. You may not reproduce, copy, distribute or modify any content without written permission.

4. Third Party Links

This website may include links to third party websites or tools. These are provided for convenience only. We are not responsible for the content, availability, performance or security of third party sites.

5. No Warranty

The website is provided on an “as is” and “as available” basis. We do not guarantee that the website will always be available, uninterrupted or error free.

To the fullest extent permitted by law, Content Caster is not liable for any loss or damage arising from your use of the website.

These Website Terms are governed by the laws of England and Wales.

Part B: Client Service Terms

These terms apply when you purchase any webinar-related service from Content Caster.

1. Definitions

Client means the individual or organisation purchasing services from Content Caster.
Services means webinar planning, creation, hosting, production, event management and related deliverables provided by Content Caster.
Event means the live webinar or online session managed by Content Caster.
Attendee Data means personal data belonging to webinar attendees.

2. Scope of Services

Content Caster will:
• create your webinar event in our Eventbrite account (or agreed platform)
• design branded eCamm scenes
• host and produce the webinar using Zoom Workplace or similar, including technical management
• coordinate speakers and panellists
• provide a recording of the webinar to the Client after the event

Any additional services (such as post-event editing, distribution or consultancy) must be agreed in writing.

3. Client Responsibilities

The Client agrees to:
• provide all necessary information, access and materials in a timely manner
• supply presentation slides and content at least 5 working days before the Event
• ensure speakers are informed of recording and participation terms
• communicate with Content Caster promptly regarding event decisions

Any delay caused by the Client may impact delivery timelines or incur additional charges.

4. Fees and Payment

• All fees are payable in full upfront before any work begins.
• Work will not commence until payment has been received.
• Fees are non refundable except in exceptional circumstances, at the sole discretion of Content Caster.

5. Cancellation and Rescheduling

• Clients may request a reschedule with at least 7 days’ notice.
• New dates are subject to availability.
• Cancellations do not qualify for a refund except in exceptional circumstances as determined by Content Caster.

6. Webinar Recording and Usage

• Content Caster records webinars for the Client to use and share after the Event.
• Unless the Client opts out in writing, Content Caster may use excerpts, screenshots or short clips for our own marketing, portfolio or promotional purposes.
• If the Client opts out, we will not use the material for external marketing.

7. Speaker and Panellist Consent

• The Client is responsible for informing speakers and panellists that the Event will be recorded.
• By participation, speakers grant permission for the recording and for Content Caster and the Client to use the content for the purposes outlined in section 6.
• If the Client opts out of marketing usage, the recording will be used only for the Client’s internal purposes.

8. Intellectual Property

• The Client retains ownership of their presentation content, branding and intellectual property used during the Event.
• Content Caster retains ownership of the webinar production assets created for the Event, including eCamm scenes, overlays and templates.
• Clients receive a licence to use the delivered recording and assets for business promotion and content distribution.

9. Data Protection

Both parties agree to comply with UK GDPR.

• The Client is the Data Controller for attendee data.
• Content Caster acts as the Data Processor, processing attendee data only as instructed by the Client.
• Content Caster may use third party platforms such as Eventbrite, Zoom, eCamm, Google Workspace and Mailchimp to deliver services.
• Content Caster will not add attendee data to our own marketing database.

10. Confidentiality

Both parties agree to keep confidential any business, commercial or sensitive information shared for the purpose of delivering the Services.

11. Liability and Indemnity

• Content Caster’s total liability for any claim arising out of the Services is limited to the total fees paid by the Client.
• Content Caster is not liable for indirect, consequential or business losses, loss of reputation, loss of profit or data loss.
• The Client agrees to indemnify Content Caster against any claim made by a third party (including speakers or attendees) arising from the Client’s failure to obtain necessary permissions or comply with laws.

12. Termination

Either party may terminate the agreement if the other party materially breaches the terms and does not remedy the breach within 14 days of written notice. Fees are still payable for work already completed.

13. Force Majeure

Neither party is liable for delays or failure to perform due to events outside their reasonable control, including technology outages, strikes, illness, or platform failures.

14. Governing Law

These Service Terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.
